In one county, yes. Tennessee adds a $62.50 fee to every marriage license under T.C.A. 36-6-413, and couples normally avoid $60 of it by completing a four-hour premarital preparation course within one year of applying. The University of Tennessee's County Technical Assistance Service notes a second exemption for couples who get their license in a county with a municipality defined as a premier type tourist resort and who provide proof of non-residency, and it states that this currently includes only Sevier County. Everywhere else, the course is the way to save. Nashville lists its license at $99.50 in cash, with a $60 saving for couples who bring a notarized course certificate.
Great Smoky Mountains National Park allows ceremonies at its historic churches for up to 50 people, 1.5 hours and 8 vehicles unless otherwise noted, while outdoor locations are limited to 25 people, 1 hour and 6 vehicles. The Methodist, Missionary Baptist and Primitive Baptist churches in Cades Cove are on the Tennessee side, while Palmer Chapel at Cataloochee and Smokemont Church are in North Carolina. Applications are accepted up to 12 months ahead and no later than 30 days before the event, with a $50 application fee, and items such as tents, tables, garden arches and confetti are prohibited.
It is still a risk. T.C.A. 36-3-301 requires ministers to be ordained by a considered, deliberate and responsible act, and the statute has not been repealed. A 2023 federal case brought by the Universal Life Church ended with stipulations in which only the district attorneys for Rutherford, Hamilton and Putnam counties and the Putnam County clerk agreed not to challenge those marriages, and the case was dismissed with prejudice. Those stipulations bind only those officials. County clerks also cannot require proof of an officiant's credentials, so a license being accepted does not settle the question. Couples who want certainty can choose a judge, a county clerk or another official listed in the statute, or a minister ordained by an established congregation.
The officiant does. The County Technical Assistance Service's marriage license reference says the officiant returns the completed license to the issuing county clerk within three days of the marriage. Tennessee law does not require witnesses, so the officiant's signature is what completes the record. The license itself is valid for 30 days after issuance, and any Tennessee county clerk can issue it no matter where the couple lives or where in the state the ceremony takes place.

Ministers must be ordained by a considered, deliberate and responsible act, which is why online ordination remains a gray area: the 2023 Universal Life Church case ended with stipulations binding only three district attorneys and the Putnam County clerk, the case was dismissed with prejudice, and the statute is unchanged.
