Terms of Service for Pix Wedding
Acceptance of Terms By accessing and using Pix Wedding (the "Service"), you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree with these Terms, please refrain from using the Service. Service Description Pix Wedding is a web application that allows users to create personalized QR codes for their special events, enabling guests to upload photos and videos directly to a personal photo album. Users can also create and manage photo albums within the application, adding titles to each album. The generated QR code provides access to these albums, facilitating photo sharing during occasions such as weddings, birthdays, and festivals. User Access and Account Management To access Pix Wedding, users must log in using a Google account or a magic link. Users are responsible for maintaining the confidentiality of their login information. To delete your account, please reach out to us at info@pix.wedding. User Responsibilities Users bear full responsibility for the content they upload. You must ensure that you and your guests upload only appropriate content. If you prefer not to allow guests to view or download uploaded photos and videos, you can disable these options in your dashboard. Please remember that anyone with access to the upload link or album page can view these pages, so share links and QR codes cautiously. Consequences of Violating Responsibilities Users are entirely responsible for their content and any legal consequences that may arise from it. Pix Wedding is not liable for any repercussions resulting from users' actions. Content Ownership and Usage Rights Users retain full ownership of the content they upload. The operator does not utilize, share, or claim any rights to users' files. Users grant the operator a global, non-exclusive, royalty-free license to use, reproduce, and distribute uploaded content within the Pix Wedding service, solely for the purpose of providing the service as outlined in these Terms. Intellectual Property All content, trademarks, and intellectual property rights associated with Pix Wedding remain with the operator or the respective rights holders. Users do not acquire rights to the content or intellectual property of Pix Wedding, except for those expressly granted under these Terms. Users retain exclusive rights to their uploaded photos and videos, granting the operator a non-exclusive license to use them within the Service. Unauthorized copying, modifying, or distributing of Pix Wedding's content or intellectual property is strictly prohibited. Users may not upload or share content that infringes upon the intellectual property rights of the operator or third parties. The operator reserves the right to remove any infringing content or restrict access to the service. If users believe their intellectual property rights are violated, they may notify the operator, who will investigate and respond appropriately. Data Storage and Liability Limitation User data is stored on Cloudflare's secure infrastructure. Although we endeavor to maintain data integrity, the operator is not responsible for any data loss or service interruptions. By using the Service, you accept all risks associated with your uploaded content. All images, videos, and associated albums will be deleted from the system 12 months after the date of purchase. It is the user's responsibility to download any content they wish to keep before this period expires. The operator assumes no liability for any loss of content due to automatic deletion after this time. Termination of Service The operator reserves the right to terminate a user's access to the Service for misuse or violations of these Terms. Users will be notified of any termination. Upon termination, uploaded data may be deleted, particularly in the premium version, where files will be auto-deleted 12 months after the upload date. Dispute Resolution Disputes arising from or related to these Terms will be resolved through arbitration in accordance with the laws of Czechia. All disputes will be adjudicated in the courts of Czechia. Severability If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain valid and enforceable. Security Reports and Public Disclosure Pix Wedding does not operate a vulnerability disclosure program or bug bounty program. The operator does not offer compensation for unsolicited security reports. Users, researchers, or third parties must not submit security or vulnerability reports with an expectation of reward, payment, or public acknowledgment; attempt to extort compensation through the threat of disclosure; or publicly disclose or discuss any perceived or actual vulnerabilities in the Service without prior written authorization from the operator. Any unauthorized disclosure or communication of vulnerabilities, including attempts to pressure or coerce the operator into payment, will be considered a violation of these Terms and may result in legal action. The operator reserves the right to investigate and pursue all legal remedies, including civil and criminal proceedings, in response to such actions. If you believe you have discovered a legitimate security issue, you may report it at info@pix.wedding following responsible disclosure principles, but please note that we do not guarantee any response, acknowledgment, or reward. Transfer of Rights Users may not transfer their rights or obligations under these Terms to any other party without prior written consent from the operator. Updates to the Terms We may update these Terms from time to time. Continued use of the Service after any changes constitutes acceptance of the new Terms. Governing Law These Terms are governed by and construed in accordance with the laws of Czechia. Legal Fees Users acknowledge that in the event of any disputes or claims arising from these Terms or the use of Pix Wedding, the operator has the right to recover reasonable attorney's fees and court costs incurred in connection with such matters.
